These Terms are effective from 1 January 2026 and apply to all use of the Site from that date onward.

Definitions

For the purposes of these Terms, the following definitions apply:

  • Operator: The unidentified legal or natural person that owns and/or operates the Site and the Darwin brand at darwin-au.com. The exact corporate name, registration number, address and licensing status are not verified or publicly specified.
  • Darwin: The trading name and brand used in connection with the Site and services provided via darwin-au.com, including any reviews, gaming-related content and associated functionality.
  • Darwin: The internal project/build name associated with the Darwin-branded services and review content made accessible via darwin-au.com for users located primarily in Australia.
  • Site: The online interfaces, pages, products, content, tools and services made available at https://darwin-au.com and any subdomains or mobile versions.
  • User: Any person who accesses or uses the Site in any manner, whether or not they complete registration or place any bets or wagers.
  • Player: A User who has created an account on the Site (if and when account functionality is offered) and who participates in wagering, betting, or any real-money or prize-based gaming activities offered via the Site.
  • Account: The personal profile that may be created by a User on the Site, including login credentials, personal details, transaction history, and settings.
  • Bet / Stake: Any sum of money or monetary value placed by a Player on an outcome offered by the Operator, including but not limited to casino games, slot spins, table games, or other forms of real or simulated gambling.
  • Wager: The act of placing a Bet, and, where relevant, also the total amount of money that must be bet in accordance with specific bonus or promotion requirements.

  • Unregulated Operation: The status of the Site as an online operation for which no valid, verifiable Australian or international gambling licence has been identified or confirmed by any reputable regulator as of 1 January 2026.
  • Responsible Gambling Tools: Any limits, self-exclusion mechanisms or other features which may be implemented to help Users manage their gaming behaviour. Availability of such tools on the Site is not guaranteed.

Account Registration

Eligibility and Age Verification

  • Minimum age requirement: Access to any gambling or betting functionality on the Site is strictly limited to individuals who are at least 18 years of age. By creating an Account or using any Service that involves wagering, you confirm that you are 18+ and legally permitted to gamble under AU Laws and any laws applicable in your place of residence.
  • Jurisdictional restrictions: The Site targets Users located in Australia but operates on an offshore, not locally licensed basis. Under the Interactive Gambling Act 2001 (Cth), provision of many forms of online gambling services to persons in Australia without an Australian licence may be illegal. You are solely responsible for ensuring that accessing and using the Site is lawful in your jurisdiction and for discontinuing use if it is not.
  • Verification of age: The Operator may, at any time, request documentary proof of age and identity, and may suspend or close an Account until satisfactory evidence is provided. If a Player is found to be under 18, any Bets may be voided and winnings may be forfeited.

Account Creation Process

  • Registration steps: To create an Account (if and when registration is enabled), you will be required to:
    1. Provide a valid email address and choose a secure password.
    2. Provide personal details such as your full name, date of birth, and country of residence.
    3. Confirm that you have read, understood and accepted these Terms and the Privacy Policy.
    4. Verify your email address by clicking on a confirmation link sent to the email you provided.
  • Accuracy of information: You must ensure that all information provided during registration or thereafter is true, complete and up to date. The Operator is entitled to rely on information supplied by you and will not be liable for losses caused by inaccurate or outdated details.
  • One account policy: Unless explicitly authorised in writing, you may hold only one Account with the Operator. Creation or use of multiple Accounts ("duplicate accounts") may result in closure of all such Accounts and forfeiture of Bonuses and/or winnings.

KYC and Ongoing Verification

  • Identity checks: At its discretion and as may be required by payment providers, the Operator may conduct KYC checks. You may be asked to provide, among other things:
    • A clear copy of a valid government-issued photo ID (passport, driver's licence or national ID card).
    • Proof of residential address (utility bill, bank statement) not older than three (3) months.
    • Proof of ownership and lawful use of the payment instruments used (e.g. card statement, e-wallet screenshot).
  • Suspension during verification: During KYC reviews, your ability to deposit, wager or withdraw may be temporarily limited. The Operator is not obligated to approve any transaction until KYC reviews have been satisfactorily completed.

User Obligations and Account Security

  • Login security: You are responsible for keeping your login credentials confidential and for all activities carried out through your Account. You must:
    • Choose a strong password and change it periodically.
    • Not share your credentials with any third party.
    • Immediately notify the Operator at [email protected] if you suspect that your Account has been compromised.
  • Use for own benefit only: You may not allow any other person to use your Account, and you may not act on behalf of or for the benefit of any other person in connection with the Site.
  • Compliance with laws: You agree to comply with all applicable AU Laws and any other applicable laws when using the Site, including any restrictions on online gambling in your jurisdiction. If you are unsure about the legality of your use of the Site, you must seek independent legal advice and/or cease using the Site.

Betting & Gameplay Rules

General Principles

  • Game rules: Each game or product made available via the Site is subject to its own specific rules, pay tables, and procedures as displayed within the game interface or on associated information pages. By participating, you agree to be bound by those rules in addition to these Terms.
  • Randomness and fairness: Where real-money games are offered, outcomes should be determined by random number generation or other fair procedures. However, given that no valid regulatory licence has been verified for the Operator, fairness is not independently certified and you accept this risk when using the Site.

Placing Bets and Wagers

  • Minimum and maximum stakes: Each game may specify minimum and maximum Bet limits. You are responsible for checking these limits before placing a Bet. Attempts to exceed limits may result in automatic rejection of the Bet.
  • Bet confirmation: A Bet is deemed placed when it has been accepted by the game server and appears in your game history or transaction log as "confirmed" or equivalent. Once accepted, a Bet generally cannot be cancelled or modified by you.
  • Currency and rounding: Bets and payouts are processed in the base currency or currencies supported by the Site and indicated in the cashier section. Minor discrepancies due to rounding or currency conversion may occur and are accepted by you.

Cancellation, Errors and Misuse

  • Obvious errors (palpable errors): The Operator reserves the right to void or adjust Bets that were accepted at clearly incorrect odds, pay tables, or due to an evident technical malfunction. In such cases, the Operator's decision as to whether an error has occurred will be final.
  • Technical interruptions: If your game session is interrupted (e.g. due to loss of internet connection) after a Bet has been placed, the outcome may still be processed by the server. The result, as recorded by the server, will be decisive. Any refunds related to interruptions will be handled in line with the specific game rules.
  • Fraud, collusion and prohibited strategies: You must not:
    • Exploit software bugs or loopholes.
    • Use bots, scripts, AI or other automated tools to place Bets.
    • Collude with other Players or engage in chip dumping, arbitrage or other unfair advantage play.
If the Operator reasonably suspects such conduct, it may void Bets, confiscate winnings and close Accounts.

Conduct in Live Casino and Chats

  • Respectful behaviour: Where live casino tables or chat functions are available, you must treat dealers, support staff and other Players with respect. You must not use language or content that is:
    • Abusive, threatening, defamatory, racist, sexist or otherwise discriminatory.
    • Sexually explicit, obscene or harassing.
    • Promotional, spam-like or related to other gambling sites.
  • No solicitation or data harvesting: You may not request or share personal contact details of others, direct them to third-party sites, or attempt to harvest data from chats or live games.
  • Moderation: The Operator may monitor chats and live interactions, edit or remove content, mute Players or suspend Accounts where conduct is inappropriate or in breach of these Terms.

Bonus Terms

Bonus Allocation and Activation

  • Discretionary offers: Bonuses, free spins, cashback and similar promotions (collectively "Bonuses") may be offered from time to time at the Operator's sole discretion. Eligibility criteria (e.g. minimum deposit, country restrictions, time-limited campaigns) will be set out in the specific promotion rules.
  • Activation requirements: To activate a Bonus you may be required to:
    • Opt in via a promotion page or in-account banner.
    • Enter a bonus code when depositing.
    • Meet a minimum qualifying deposit amount within a specified period.
Failure to meet activation conditions may result in the Bonus not being credited.

Wagering Requirements and Timeframes

  • Playthrough: Unless otherwise specified, Bonus funds and any associated winnings are subject to wagering requirements before they can be withdrawn. For example, a 30x wagering requirement on a AU$100 Bonus means total eligible Bets of AU$3,000 must be placed.
  • Contribution of games: Different games may contribute differently towards wagering requirements (e.g. slots 100%, table games 10%, some games 0%). The specific contribution table will be set out in the relevant promotion terms. Bets on excluded or low-contribution games may not count toward wagering.
  • Time limits: Bonuses are typically subject to expiry dates (e.g. 7 - 30 days from crediting). Unused Bonus funds and any winnings derived from them may be forfeited upon expiry. You are responsible for monitoring applicable deadlines.

Prohibited Actions Relating to Bonuses

  • Abuse of promotions: The following, without limitation, may be treated as Bonus abuse:
    • Opening multiple Accounts to claim the same offer more than once.
    • Delaying game rounds (e.g. free spin features) or using low-risk betting strategies solely to meet wagering requirements.
    • Placing large Bets with Bonus funds after a significant win while using minimal-risk Bets prior to that win.
  • Consequences of abuse: If the Operator reasonably believes a Bonus or promotion has been abused, it may:
    • Cancel the Bonus and associated winnings.
    • Adjust Account balances.
    • Close or suspend the Account.

Combining Promotions

  • No stacking unless allowed: Promotions usually cannot be used in combination unless explicitly permitted in the relevant promotional terms. Where multiple promotions appear to overlap, the Operator may decide which applies or in what order.
  • Real money vs Bonus money: In many cases, real-money balances will be used before Bonus balances. Specific priority rules will be set out in bonus-specific terms and may affect your ability to withdraw.

Payments & Withdrawals

Deposit Methods and Conditions

  • Payment options: Subject to availability in your region and at the Operator's discretion, deposits may be accepted via:
    • Bank cards (e.g. Visa, Mastercard).
    • E-wallets and online payment services.
    • Bank transfers.
    • Cryptocurrencies, if explicitly supported.
Exact methods supported by darwin-au.com are not guaranteed and may change without notice.
  • Ownership of payment instruments: You must only use payment methods that are registered in your own name. Use of third-party cards or accounts is prohibited and may result in reversed transactions and Account closure.
  • Deposit limits and fees: Minimum and maximum deposit limits, as well as any applicable fees or currency conversion charges, will be displayed in the cashier section. The Operator may change such limits and fees at any time.

Withdrawal Requests

  • Verification prior to withdrawal: Before processing any withdrawal, the Operator may require completion of KYC checks as described above. Until all requested documents are provided and verified, withdrawals may be delayed or refused.
  • Method of payment: Where possible, withdrawals will be processed via the same method used for deposit, subject to the rules of the payment provider. If that is not possible, an alternative method may be offered at the Operator's discretion.
  • Processing times: The Operator seeks to review withdrawal requests within a reasonable time (for example, 24 - 72 hours). However, no specific processing time is guaranteed, and additional delays may arise due to verification checks or third-party payment providers.
  • Withdrawal limits: Minimum and maximum withdrawal limits per transaction, day, week or month may apply and will be indicated in the cashier or relevant information pages.

Fees, Chargebacks and Refunds

  • Transaction fees: The Operator may apply fees to deposits or withdrawals to cover processing costs or exchange-rate charges. Any such fees will be displayed in the cashier where practicable, but some third-party bank or payment provider charges may not be fully controlled or disclosed by the Operator.
  • Chargebacks: Initiating chargebacks or payment disputes without valid cause is prohibited and may lead to immediate suspension or closure of your Account. The Operator reserves the right to recover any costs incurred from you and to report fraudulent behaviour to relevant authorities and payment providers.
  • Refund policy: Bets that have been confirmed and settled according to game results are generally non-refundable. In exceptional circumstances (e.g. material technical faults, errors in game operation), the Operator may, at its sole discretion, cancel affected Bets and refund stakes to the Player's Account or otherwise adjust balances.

Bonuses and Withdrawals

  • Separate treatment of Bonus funds: Withdrawals from Accounts that include active Bonuses may be restricted until wagering requirements are met. Requesting a withdrawal before completing required wagering may result in the cancellation of the Bonus and associated winnings.
  • Right to withhold: The Operator may withhold withdrawals where:
    • There is an ongoing investigation of suspected fraud, money laundering, or Bonus abuse.
    • Requested KYC or source-of-funds documentation has not been provided or is unsatisfactory.
    • The Operator is directed to do so by law, a court order, or a governmental authority.

Limitation of Liability

Operator's Obligations and Service Availability

  • Reasonable efforts: The Operator will use reasonable efforts to:
    • Maintain the technical operation of the Site and games.
    • Ensure that game results are determined by the underlying software and rules.
    • Safeguard User data in accordance with the Privacy Policy.
However, the Site is provided on an "as is" and "as available" basis. Continuous, error-free or virus-free operation cannot be guaranteed.
  • Unregulated status: No valid or verifiable gambling licence has been confirmed for the Operator as of 1 January 2026. You explicitly acknowledge and accept the heightened legal and financial risks associated with using an unregulated online gambling service, including a lack of oversight by Australian or reputable international regulators and the absence of guaranteed dispute resolution mechanisms.

Exclusions of Liability

  • Technical and external factors: To the maximum extent permitted by AU Laws, the Operator is not liable for any loss or damage arising from:
    • Interruptions, delays or failures in telecommunications or internet services.
    • Software bugs, viruses, or other defects not caused by gross negligence or wilful misconduct of the Operator.
    • Incompatibility between your devices and the Site.
    • Unauthorised access to your Account resulting from your failure to safeguard credentials.
  • Financial losses and gambling risk: You participate in any gambling or betting activities entirely at your own risk. The Operator has no obligation to reimburse losses resulting from your Bets or gaming decisions, except where a specific Bet is voided or refunded under game or promotion rules.
  • Indirect and consequential damages: In no event will the Operator be liable for any indirect, incidental, consequential, special, punitive or exemplary damages (including loss of profits, loss of data, or loss of opportunity) arising from or in connection with your use of the Site or Services.

Maximum Liability

  • Limitation cap: Without prejudice to the above, and to the fullest extent permitted by law, the total aggregate liability of the Operator to you for any claim arising out of or relating to the Site, the Services, or these Terms (whether in contract, tort, negligence or otherwise) shall not exceed:
    • The amount of the Bet or Wager that gave rise to the relevant dispute; or
    • Where no specific Bet is identifiable, the total amount of deposits made by you to your Account during the three (3) months immediately preceding the event giving rise to the claim, up to a reasonable monetary maximum determined by the Operator.
  • Mandatory rights: Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under AU Laws, including any non-excludable guarantees under the Australian Consumer Law where applicable.

Intellectual Property Rights

  • Ownership of content: All content on the Site, including text, graphics, logos, icons, images, audio clips, video clips, software, databases, and design elements (collectively "Content"), is owned by the Operator, its licensors or content providers and is protected by copyright, trademark and other intellectual property laws.
  • Licence to use: You are granted a limited, non-exclusive, non-transferable and revocable licence to access and use the Site and Content solely for your personal, non-commercial entertainment purposes, in accordance with these Terms.
  • Restrictions: You must not, without prior written consent of the Operator:
    • Copy, reproduce, modify, adapt, translate, distribute, publish, or create derivative works from any part of the Site or Content.
    • Reverse engineer, decompile, disassemble or otherwise attempt to derive source code from any software used in connection with the Site.
    • Use any automated means (such as bots, spiders, or scrapers) to access, query, or harvest data from the Site.
  • Trademarks: "Darwin", "darwin-au.com", "Darwin" and any associated logos or brand elements used on the Site may constitute trademarks or service marks of the Operator or its partners. You acquire no rights to these marks and must not use them without express written permission.

Privacy & Data Protection

  • Privacy Policy incorporation: Your use of the Site is also governed by the Privacy Policy made available on darwin-au.com (or otherwise provided to you). By using the Site, you acknowledge that you have read and understood the Privacy Policy and agree that your personal data will be collected, used, stored and disclosed in accordance with it.
  • Data processing: The Operator may process personal information (including identity documents and payment details) for purposes including account management, KYC/verification, fraud prevention, compliance with legal obligations, and marketing (where permitted). The Privacy Policy contains further details of these purposes and your rights.
  • Cross-border transfers: Because the Operator's jurisdiction and infrastructure are not clearly specified or regulated in Australia, your personal data may be stored or processed in countries outside Australia, possibly without equivalent data protection standards. By using the Site, you consent to such transfers to the extent permitted by AU Laws.

Changes to Terms

  • Right to amend: The Operator may modify, update or replace these Terms at any time, for example to reflect changes in AU Laws, regulatory guidance, industry practices, technical developments, or the Operator's business model.
  • Notification of changes: Where material changes are made, the Operator will take reasonable steps to notify Users, which may include:
    • Publishing the updated Terms on the Site with a revised "effective date".
    • Displaying an in-site banner, pop-up or similar notice upon login or access.
    • Sending an email to the address registered to your Account, where applicable.
  • Acceptance of updated Terms: Continued use of the Site after changes become effective constitutes your acceptance of the updated Terms. If you do not agree to any amendment, you must stop using the Site and, if you have an Account, you should request closure of your Account and withdrawal of any available balance (subject to applicable requirements).

Termination & Suspension

Operator's Rights

  • Grounds for action: The Operator may, at its sole discretion and without prior notice, suspend or terminate your Account and/or restrict your access to the Site where it reasonably believes that:
    • You have breached these Terms or any game-specific rules or bonus conditions.
    • You are using the Site in contravention of AU Laws or other applicable laws.
    • You have engaged in fraud, money laundering, collusion, Bonus abuse or other improper conduct.
    • You have provided false, misleading or incomplete information during registration or KYC.
    • Your continued use of the Site may pose legal, financial or reputational risk to the Operator.
  • Consequences of termination: In the event of termination, your access to the Site and Services may be blocked, active Bonuses may be cancelled, and, subject to applicable laws and the Operator's investigation, funds in your Account may be:
    • Returned to you (where lawfully and practically possible); or
    • Retained or forfeited if they are reasonably believed to be related to prohibited conduct.

User-Initiated Closure

  • Voluntary termination: You may request closure of your Account at any time by contacting customer support at [email protected]. Prior to closure, you should withdraw any available and eligible funds from your Account, subject to standard withdrawal procedures.
  • Effect of closure: Upon closure, you will no longer be able to access your Account or history via the Site, although the Operator may retain certain records as required or permitted by law and by its internal policies.

Notice and Communication

  • Notification: The Operator will generally attempt to notify you of suspensions or terminations using the contact details linked to your Account (e.g. email). However, it is under no obligation to provide advance notice where doing so could compromise investigations or legal compliance.
  • Right to appeal: If you believe your Account has been suspended or terminated in error, you may contact customer support, provide relevant information, and request a review. The Operator's final decision will be binding, subject to any rights you may have under AU Laws.

Governing Law & Jurisdiction

  • Governing law: To the extent permitted by conflict-of-law rules, these Terms, your use of the Site, and any disputes arising in connection therewith shall be governed by and construed in accordance with the laws of the Commonwealth of Australia, without giving effect to any choice or conflict of law provision or rule that would require the application of the laws of another jurisdiction.
  • Illegality note: You acknowledge that the Site operates as an offshore-facing online operation targeting Australian Players and is not locally licensed. Provision of certain interactive gambling services to persons in Australia without an Australian licence may be unlawful under the Interactive Gambling Act 2001 (Cth). Your use of the Site may therefore contravene AU Laws, and you accept full responsibility and legal risk for any such contravention.
  • Dispute resolution: In the event of any dispute you should first contact customer support to attempt an informal resolution. If the dispute cannot be resolved amicably:
    • You agree that the courts of an appropriate Australian state or federal court may have non-exclusive jurisdiction to hear the matter; however, enforcement and practical recourse may be limited due to the unregulated status and unclear location of the Operator.
    • Nothing in these Terms prevents you from having recourse to any mandatory consumer protection or legal remedies available to you under AU Laws.

Contact Information

  • Customer support: For questions, complaints or requests regarding your use of the Site, your Account, payments, or these Terms, you may contact:
  • Telephone, mailing and legal address: As of 1 January 2026, no verified telephone number, physical mailing address, headquarters, regional office address, or formal legal address of the Operator has been specified or confirmed. Consequently:
    • All official communication should be conducted via the email address listed above or through any contact form or on-site messaging system that may be implemented on darwin-au.com.
    • In the absence of a disclosed corporate identity or postal address, your ability to pursue offline or formal legal correspondence with the Operator may be constrained.
  • Regulatory and legal enquiries: Given that no valid regulatory licence or issuing authority for the Operator has been verified, there is currently no confirmed gambling regulator responsible for handling complaints related to Darwin or darwin-au.com. Users concerned about potential breaches of AU Laws (including the Interactive Gambling Act 2001 (Cth)) may seek independent legal advice or contact relevant Australian authorities or the Australian Communications and Media Authority (ACMA) for general guidance.
